Bid Process and Criteria

Minimum Price and Administration Fee: NDAM and the seller have set a minimum price
per acre to cover NDAM transaction costs and administrative overhead.
Bid Submittal: Submit the completed online bid form below.
Bid Acceptance Priority:
1. First priority is given to the highest bid price, on a per acre basis.
2. If there are remaining acres after accepting the highest bid per acre, the
  subsequent-highest per acre bid price will be accepted for those acres.
3. Should there be a tie for the highest bid price per acre, the higher number of acres
  requested will be awarded first.
Right to Refuse Bids: The seller reserves the right to refuse all bids.
Mitigation Outside of North Dakota: NDAM will not accept bids from buyers wishing to mitigate wetland acres outside of North Dakota.
Confidentiality: All bid information will be treated as confidential to maintain fairness and
prevent collusion among bidders.
Contract Execution: Upon acceptance of bids, the seller and successful bidders will
enter into a purchase agreement outlining the terms of the credit sale, including payment
terms, and any other relevant provisions. This may include a down payment until the postaward
credit transactions can be completed.
Post-Award Phase:
1. Buyer must supply NDAM a copy of the NRCS Certified Wetland Map that identifies
  the location and acres of wetlands being mitigated through the credit sale, along
  with payment for the accepted bid (price per acre × number of acres) within 15
  days of bid award.
2. Wetlands are to be mitigated within the same RSA (watersheds), unless otherwise approved by NRCS. View the regional service areas map. NDAM will coordinate the mitigation transaction with North Dakota NRCS. Buyers will not be held responsible for credit purchases if NRCS rejects the mitigation request.
3. NRCS is responsible for reissuing Certified Wetland Determinations to the buyer
  for mitigated wetland(s) as “MIW” (Mitigation Exemption) after the credit sale
  process is completed.

Current Credits Available:

There are currently a maximum of 4.57 acre-credits available for bid in the Missouri River Basin
South (RSA 3). NDAM and the seller have set a a minimum price per acre at $12,000/acre.

There are currently a maximum of 0.26 acre-credits available for bid in the Red River Basin
(RSA 6). NDAM and the seller have set a a minimum price per acre at $12,500/acre.

Bids for these credits will be awarded on a first come, first served basis.
